  1. The application is a android/IOS platform that, by providing an interface, only facilitates online security alert services for Doctors/ hospital  in accordance with the Applicable Laws.  You acknowledge  therefore in no event EHSAS, neither will be directly and/or vicariously liable for any deficiency in the services, negligence, criminal misconduct, noncompliance with Applicable Laws etc; of the other Party nor guarantee and/or provide warranties of the performance/quality of services under this Agreement. ?

  2. This application does not recommend or endorse any specific procedures, opinions, or other information that may be mentioned herein. Placing reliance on any information provided shall solely be at your own risk. In case of any crucial conditions or emergency, we advise you to contact your nearest police station or any related helpline.

  3. By accessing, browsing, using or in any way transacting/interacting with this application, or availing the services, You expressly agree to be unconditionally bound by these Terms of Use, our policies, including but not limited to the privacy policy and such other rules, guidelines, policies, terms and conditions, Applicable Law(s) as amended, as are relevant under and such applicable laws, rules, guidelines, policies, terms and conditions shall be deemed to be incorporated into, and considered as part and parcel of these Terms of Use.

  4. If You navigate away from the Application to a third party application, You may be subject to alternative terms and conditions of use and privacy policy, as may be specified on such application. In such event, the terms and conditions of use and privacy policy applicable to that application will govern Your use of that application. You agree that EHSAS has no control over and shall neither be directly and/or vicariously liable for any deficiency in the services, negligence, criminal misconduct, noncompliance with Applicable Laws etc; nor guarantee and/or provide warranties of the performance/quality of services of such third party web based/android/IOS platform/application.

  5. The Services offered through this application can only be used in compliance with the provisions of the Applicable Laws, like  Guidelines and/or any other statutory provisions/rules/regulations/notifications/orders issued/enacted by the Government (whether Central/State/Local) as amended, and/or order/decree/direction issued by the Courts/Executive, and not for use in crucial emergencies or for critical emergency  situations requiring prompt  attention, wherein you are advised to contact Your nearest police station or any related helpline.

  6. These Terms of Use constitute an electronic record in terms of the IT Act and rules framed there under, as applicable and amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

  7. For a better experience while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to [Name, Mobile no, Address (including country and ZIP/ postal code), Location, Hospital or clinic name, Qualification: Registration No (Doctor/dentist/ Physiotherapist),Payment gateway details. The information that we request is [retained on your device and is not collected by us in any way, will be retained by us and used as described in this privacy policy. For the purposes of availing the Services through this application, you are required to obtain registration. As part of the registration process, EHSAS may collect, store, use and disseminate the information.

  8. The app does use third party services that may collect information used to identify you. This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. I have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

  9. This Services does not uses these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collection information and to improve their services. You have the option to either accept or refuse these cookies, and know when a cookie is being sent to your device.   10. Your right to use the application and the Services are strictly non-transferable. As a condition to your use of the application, you must be 18 (eighteen) years of age or older. You agree and acknowledge that You would (i) create only 1 (one) account; (ii) provide accurate, truthful, current and complete Information using the Services all Your dealings through this application; (iii) maintain and promptly update Information; (iv) maintain the security of Your account by not sharing Your password or M pin with others and restricting access to Your account and Your device; (v) promptly notify EHSAS at support@ ~*Our firm. Email address*~ if You discover or otherwise suspect any security breaches relating to the application; and (vi) take responsibility for all the activities that occur under Your account and accept all risk of unauthorized access.

  12.  You agree to defend, indemnify and hold harmless EHSAS, its directors, officers, employees, representatives, agents, contractors, the protected entities, independent contractors, service providers, consultants, licensors, and each of their respective directors, officers and employees, from and against any and all claims, losses, liability, damages, and/or costs (including, but not limited to, reasonable attorney fees and costs) arising from or related to (a) unauthorized access to or use of application; (b) violation of these Terms of Use or any applicable law(s); (c) violation of any rights of another person/ entity, including infringement of their intellectual property rights (d) any negligence.

  13.  EHSAS, at its sole discretion, reserves the right to permanently or temporarily suspend Users, to bar their use and access of the application, at any time while EHSAS investigates complaints or alleged violations of these Terms of Use or any Services, or for any other reason.

  14. EHSAS reserves the right to change or modify these Terms of Use or any policy or guideline of the application including the privacy policy, at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions on the application and You waive any right You may have to receive specific notice of such changes or modifications. Your use of the application will confirm Your acceptance of such changes or modifications; therefore, You should frequently review these Terms of Use and applicable policies to understand the terms and conditions that apply to Your use of this application.

  15. EHSAS authorizes You to view and access the content available on the application solely for the purposes of availing the Services, such as visiting, using, ordering, receiving, delivering and communicating only as per these Terms of Use.

  16. This Application and its contents like source code, UI/UX, is the sole and exclusive property of EHSAS and is protected under copyright, trademark and other applicable law(s).

  17. We value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.

  18. The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Owner at any time.

The Owner may process Personal Data relating to Users if provision of Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof; processing is necessary for compliance with a legal obligation to which the Owner is subject; processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Owner; processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third party. In any case, the Owner will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

The Data is processed at the Owner's operating offices and in any other places where the parties involved in the processing are located. The data shall not be shared with other country.

  1. Retention time

Personal Data shall be processed and stored for as long as required by the purpose they have been collected for. Therefore: Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.

Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. Once the retention period expires, Personal Data shall be deleted. Any requests to exercise User rights can be directed to the Owner through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by the Owner as early as possible and always within one month.

Changes to this privacy policy- The Owner reserves the right to make changes to this privacy policy at any time by notifying its Users on this page and possibly within this Application and/or - as far as technically and legally feasible - sending a notice to Users via any contact information available to the Owner. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom.  Should the changes affect processing activities performed on the basis of the User’s consent, the Owner shall collect new consent from the User, where required.

  2.  These Terms of Use and any contractual obligation between you and EHSAS will be governed by the laws of India, without reference to the conflict of laws principles. Any legal action or proceeding related to the access, or use of, the application or these Terms of Use shall be subject to the exclusive jurisdiction of the courts at JAIPUR. All disputes will be subject to arbitration at JAIPUR in English by a sole arbitrator appointed by EHSAS under the Arbitration and Conciliation Act, 1996.

YOU UNDERSTAND AND ACKNOWLEDGE THAT THE SITE SHOULD NOT BE USED AS SUSTITUTE OF COMPETENT STATUTORY BODIES, LAW ENFORCING AGENCIES AND IN CASE OF EMERGENCY YOU ARE ADVISED TO CONTACT NEAREST POLICE STATION WITHOUT TAKING LAW IN YOUR OWN HANDS AND COMPLYING WITH THE LAW OF THE COUNTRY LIKE A RESPONSIBLE LAW ABIDING CITIZEN.
